Acceptance of Terms

By downloading, installing, or using GibMeme Strategist (the "App", "GMS"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not install or use the App.

These Terms form a binding agreement between you and Pukapasoft ("we", "us", "our"), the publisher of GibMeme Strategist. These Terms apply to all versions of the App, however distributed (Solana dApp Store, signed APK, or otherwise).

What the App Does

GibMeme Strategist is a tactical companion application for the gib.meme on-chain card tournament played on the Solana blockchain. The App provides tier-gated forecasts of card power, deck-building tools with survival probability math, holdings tracking, optional wallet scanning for owned cards, and on-chain identity display.

The App reads public on-chain data and public market data sources to compute its forecasts. The App is a strategy tool — it does not play gib.meme on your behalf, does not custody assets, and does not trade tokens.

The App is not affiliated with the gib.meme tournament operator. We are an independent third party building a companion tool. We do not control gib.meme's rules, scoring, payouts, or availability.

Wallet & Transactions

GibMeme Strategist uses Mobile Wallet Adapter (MWA) to authenticate your Solana wallet. Authentication is used to identify you for tier verification and to associate on-chain purchases. We never request authority to initiate transactions without your explicit confirmation in your wallet application.

You are solely responsible for ensuring your wallet is funded and that you are authorising the correct transaction before signing. We are not responsible for losses arising from mistaken transactions, wrong amounts, network congestion, or wallet errors outside of our control.

Your public wallet address will be stored on our backend to associate your tier license and consumable balances. By using the App, you consent to this storage as described in our Privacy Policy.

Tiers & Purchases

GibMeme Strategist offers five tiers (Free, Premium, Golden, Platinum, Diamond) and consumable products in the in-app shop (forecast boosts, wallet-scan charges, shop slider items).

• Tier upgrades — permanent, wallet-bound, verified on-chain. Cannot be transferred to another wallet. Tier credits accumulate, so upgrade prices reflect what you've already paid.
• Consumable purchases (scan charges, etc.) — consumed as the App uses them. Consumed balances are not restored on uninstall and reinstall, since they are tracked server-side per wallet.
• Pricing in tokens — all prices are denominated in SOL or SKR token amounts. We make no representations about the fiat-currency equivalent of any price. Token values are volatile.
• SKR payments — SKR is accepted as payment at the live SOL-equivalent rate on the network. No bonus, no discount; same value either way.
• No refunds — all purchases are final. On-chain transactions cannot be reversed. See Section 3.

Tier access and consumable balances are subject to backend verification. We reserve the right to revoke access for fraudulent purchases, chargeback attempts, or abuse of the verification system.

Forecasts & Strategy Tools

Forecasts, deck-power projections, survival probabilities, and any other predictive output of the App are statistical estimates derived from public on-chain data and historical market behavior. They are not guarantees, predictions of certainty, or investment advice.

We make no warranty that any forecast will be accurate, that any deck recommendation will perform well, or that the App's tools will produce winning strategies. Card power, projections, and rankings are advisory and may differ from gib.meme's own scoring.

Nothing in the App constitutes financial advice, investment advice, or a recommendation to acquire, hold, or dispose of any token. You are solely responsible for your gib.meme tournament participation and for any tokens you own or transact with.

Prohibited Conduct

You agree not to use the App to:

• Reverse engineer the App — decompile, disassemble, or attempt to extract source code beyond what is permitted by applicable law.
• Tamper with verification — attempt to forge, replay, or manipulate on-chain transaction proofs submitted to our backend for tier or consumable verification.
• Abuse rate limits — flood our backend with requests, bypass rate limits with multiple wallets, or otherwise interfere with service availability.
• Circumvent restrictions — use modified versions of the App, root exploits, or external tools to bypass tier enforcement, consumable consumption, or scan charges.
• Misuse on-chain identity — impersonate other wallet holders, set deceptive identity names, or otherwise attempt to mislead the in-app community.
• Use the App against gib.meme's terms — operate the App in any manner that violates gib.meme's own terms of service or rules of play. Compliance with gib.meme's terms is your responsibility, not ours.

Violation of these prohibitions may result in immediate termination of your access to App features, without refund of any purchases.

Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We are not responsible for: losses arising from Solana network downtime, wallet provider outages, on-chain congestion, changes to the gib.meme tournament platform, removal of cards from the gib.meme card pool, scoring methodology changes by gib.meme, or actions taken by third-party services that affect on-chain data sources we depend on.

Cryptocurrency and token values (SOL, SKR, gib.meme card tokens) are volatile. We make no representations about the future value of any token used in or referenced by the App.

Limitation of Liability

To the maximum extent permitted by applicable law, Pukapasoft shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of funds, loss of data, loss of profits, missed tournament rounds, or service interruption, arising out of or in connection with your use of the App.

Our total aggregate liability to you for any claim arising under these Terms shall not exceed the total amount you paid for App purchases in the twelve months preceding the claim. Given the nature of on-chain transactions, this amount is verifiable on the Solana ledger.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the minimum extent permitted by applicable law.

Termination

You may stop using the App at any time. Uninstalling the App terminates your use of it. Your tier license — which is on-chain — is unaffected by uninstall and remains valid for the wallet associated with it. Server-side records associated with your wallet may be deleted on request per our Privacy Policy.

We reserve the right to suspend or terminate your access to App features (including tier benefits and shop access) at our discretion if we determine you have violated these Terms, engaged in fraudulent activity, or abused our backend systems. Termination for cause does not entitle you to a refund.

We also reserve the right to discontinue the App or any of its features entirely. In the event of discontinuation, we will make reasonable efforts to provide notice through the App or website. Tier upgrades and consumable balances have no guaranteed monetary redemption value in the event of discontinuation.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts of the Czech Republic for any dispute arising under these Terms.

If you are an EU consumer, you retain any mandatory protections provided by the consumer protection laws of your country of residence that cannot be contractually waived. Nothing in these Terms limits your statutory rights as an EU consumer.

Changes to Terms

We may update these Terms to reflect changes in the App, applicable law, or our practices. When we do, we will update the "Last updated" date at the top of this page and, for material changes, post a notice in the App.

Continued use of GibMeme Strategist after updated Terms are posted constitutes your acceptance of the revised Terms. If you do not agree with a change, you must stop using the App. Your on-chain purchase history is unaffected by your decision to stop using the App.

GibMeme Strategist and all associated software, design, graphics, text, and branding are the exclusive intellectual property of Pukapasoft. All rights reserved.

You may not copy, reproduce, modify, distribute, reverse engineer, or create derivative works from any part of the App or its assets without prior written permission from Pukapasoft.

The "GibMeme Strategist" name and Pukapasoft visual identity are proprietary. The "gib.meme" name and any associated marks belong to gib.meme's operators, used here in nominative reference only — we make no claim of ownership or affiliation.
